Benjamin Tree Farm Activity Area Waiver Form - PLEASE READ CAREFULLY

RELEASE OF LIABILITY, WAIVER OF CLAIMS, AND ASSUMPTION OF RISKS AGREEMENT

By signing this waiver, I (my dependents and guest(s) for which whom I have provided tickets for, waive all legal rights, including the right to sue or seek any type of claim against Benjamin Tree Farm and anyone associated with Benjamin Tree Farm.

In consideration for Benjamin Tree Farm accepting my signed waiver to visit Benjamin Tree Farm,

1. I am mentally and legally capable of signing a contract.

2. I understand that it is my responsibility to make this waiver known to my dependents and guest(s) for which whom I have provided tickets for and signed this mandatory waiver on behalf of.

3. I understand there are inherent risks visiting Benjamin Tree Farm. These risks include but are not limited to:

- Activities such as playgrounds, slides, swings, bouncing pillows (bouncy pillows), and climbing.

- Motorized farm equipment, farm tools and farm animals.

- Conditions like rocks, gravel, earth, dirt, farm debris, mud, snow, rain, hail, and ice.

- Changes in terrain, including holes in the ground.

- Conditions created by Benjamin Tree Farm or anyone associated with Benjamin Tree Farm including but not limited to workers, volunteers, machinery, animals, attractions, signage, vehicles, and other visitors.

- My own negligence or failure to use reasonable care to protect myself or others from harm.

4. I understand that many of the risks, dangers, and hazards (including but not limited to those referred above) exist throughout Benjamin Tree Farm and that the specific location and nature of these risks, dangers, and hazards are largely unmarked.

5. I understand that Benjamin Tree Farm and anyone associated with Benjamin Tree Farm does not make any guarantees as to the safety of Benjamin Tree Farm.

6. I hereby RELEASE Benjamin Tree Farm and all those associated with Benjamin Tree Farm from any and all liability for any loss, damage, expense, injury or death in which I, my dependents and guest(s) may suffer, resulting from my or their visit to Benjamin Tree Farm, due to any cause whatsoever.

7. I freely accept and fully assume all risks, dangers, and hazards, including negligence, and the possibility of loss, damage, expense, injury or death resulting therefrom, and I waive all legal rights to sue Benjamin Tree Farm and anyone associated with Benjamin Tree Farm for any harm which may happen to me, my dependents and/or guest(s).

I have had the opportunity to review this waiver prior to my admittance. I am choosing to sign this waiver on my own free will and on behalf of my dependants and guest(s).
